Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Pure Papers mobile application ("App") provided by ArrayPress Limited ("we," "us," or "our"), a company registered in Scotland with company number SC695266 and registered office at 73 Stirling Business Centre, Wellgreen Place, Stirling, Scotland, FK8 2DZ.

By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Pure Papers provides users with access to a collection of exclusive wallpapers for personal use on electronic devices. Our service includes browsing, downloading, and using wallpapers through our mobile application.

3. Intellectual Property Rights

All wallpapers, designs, and content available through Pure Papers are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

By using our App, you are granted a limited, non-exclusive, non-transferable license to download and use wallpapers for personal, non-commercial use on your own devices. You may not:

• Redistribute, sell, or commercially exploit any wallpapers from our App
• Modify or create derivative works based on our wallpapers
• Use our wallpapers in any way that violates any applicable law or regulation
• Remove any copyright or other proprietary notices from the wallpapers

4. Subscription and Payments

Pure Papers offers both free content and premium content available through subscription plans or one-time lifetime access payment. By purchasing a subscription or lifetime access, you agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store
• No refunds will be provided for any unused portion of a subscription period or for lifetime access purchases

5. User Accounts

Some features of our App may require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account
• Update your information to keep it accurate and current
• Immediately notify us of any unauthorized use of your account
• Ensure your account is used only by you or authorized users

6. Limitations of Liability

To the maximum extent permitted by law, Pure Papers and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you have paid us, if any, for accessing or using the App during the twelve (12) months prior to the claim.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected. We cannot guarantee that any files or other data you download from the App will be free of viruses or contamination.

8. Indemnification

You agree to defend, indemnify, and hold harmless Pure Papers, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App, or you may contact us to request account deletion.

10. Privacy Policy

Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. By using the App, you consent to our collection and use of your personal data as outlined in our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Scotland, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the App shall be brought exclusively in the courts of Scotland, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.

13. Entire Agreement

These Terms constitute the entire agreement between you and Pure Papers regarding the App and supersede any prior agreements between you and Pure Papers relating to the App.

14. Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.
